This memorandum approves a class deviation to Federal Acquisition Regulation (FAR) subpart 22.8, Equal Employment Opportunity and associated provisions and clauses to stop the enforcement of FAR policies related to the now revoked Executive Order 11246, Equal Employment Opportunity. Executive Order Executive Order (E.O.) 14173, Ending Illegal Discrimination and Restoring Merit-Based Opportunity, revoked E.O. 11246.

The purpose of this memorandum is to notify the Public Buildings Service (PBS) of the Senior Procurement Executive’s (SPE) decision to grant a “class exception” from the Federal Acquisition Regulation 22.503(b) requirements to mandate the use of project labor agreements (PLAs) for all Land Port of Entry (LPOE) construction projects.

Temporary suspension of all new GSA obligations, including new awards, orders, modifications and options.

Intent to suspend enforcement of contractual DEI terms in existing agreements.
